Re-Opening a Claim Settled by a Stipulated Finding & Award
There are two ways to settle a worker's compensation case which include a Stipulated Finding and an Award and Compromise by Release. If you settled through a Compromise and Release, the terms state that you have terminated your right to future medical care and the insurance company will not pay for any additional treatment needs that arise.
However, if you settled your case through a Stipulated Finding and Award and your injury or illness gets worse you may be able to re-open the claim. In order to do this, you must have suffered a new injury or illness that causes your initial one to worsen.
